The limitations above reflect a fair allocation of risk between the parties and are a fundamental element of the basis of the bargain between you and Pizza Ranch. These limitations will apply even if Pizza Ranch has been advised of the possibility of such damages.

11. Indemnification

You agree to defend, indemnify, and hold harmless Pizza Ranch, its parent companies, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, and successors (collectively, "Indemnified Parties") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

The arbitrator may not consolidate more than one person's claims and may not preside over any form of a class or representative proceeding.

15.4 Exception for Small Claims

Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies under applicable law and the claim remains in small claims court and is not removed or appealed to a court of general jurisdiction.
